Repression in Austria

Beside the listed ones, animal right activists run daily protests at the prisons in Vienna, Wr. Neustadt and Eisenstadt. A updated list is available in antirep2008.lnxnt.org
Background information:
The grounds for the searches was the accusation Formation of a Criminal Organization according to §278a of the criminal code. There were arrest warrants for 10 of the people targeted by the searches. The basis of the arrest warrants was the accusation of Danger of the Destruction of Evidence (because, for example, the targeted people communicated via encrypted e-mails) as well as Danger of Commiting a Crime (partially because the targeted people have been active in the animal rights scene for a long time). Both lines of argumentation stand in blatant opposition to the presumption of innocence. A criminal organization is completely arbitratily constructed to be made responsible for all unsolved criminal offenses of the last few years. The accusations are not substantiated by any evidence; on the contrary - the authorities apparently hope to find evidence which confirms their suspicions through the house searches. Up til now and also in the future the suspicion of Forming a Criminal Organization can not be corroborated either by evidence or vague assumptions.
The targeted persons were brought directly from their apartments to the police detention center at Rossauer Lände. (Update: the targeted persons are now scattered in jails in Wiener Neustadt, Vienna, and Eisenstadt.) During the house searches a large part of the targeted persons were denied the ability to call a person of their confidence or legal representatives. Friends who wanted to observe the legality of the actions were also denied the possibility to speak to the targeted persons.
The actions of the authorities were out of proportion. The early morning storming of the apartments by masked WEGA officers with drawn weapons can only be described as completely excessive.
It remains unclear what the specific motive for these operations was. It can be assumed that the time and realization of these operations have a political background. In any case unpopular political actions are being criminalized and made impossible. Should this wave of repression which obviously was decreed from those in power remain unquestioned, this wave will certainly hit other forms of resistance and areas of activism.
The repression of leftist structures reached a new high point today with the wave of house searches and arrests. House searches by masked WEGA officers who kick down doors and and wake sleeping persons with drawn weapons have not been employed against the radical left in the past several years. The last time that a similar house search was made was after the Opera Ball Protest in 2001 directed against the EKH (a squat and autonomous center in Vienna).
This sort of action from the officials does not only ignite fear in the targeted persons. Friends and other activists are intended to be frightened by such actions as well. The excessive and sometimes brutal police operations try to communicate that resistance is not worth it. We can not allow ourselves to be isolated from one another. Together we can talk about our fears and develop strategies for dealing with them.
We are asking for solidarity for those targeted by the wave of repression. It does not matter if you are vegan, feminist, antifaschist, against surveillance, atomic energy or police brutality - we are all targeted, even if only a few are directly affected at the moment!
Organize benefit parties, donate money for the legal help, network with each other, inform yourself about your rights, learn about and use your right to remain silent and learn about your rights in the case of a house search!

Call Out for the Protest on June 21, 2008 in Vienna

REPRESSION KNOWS NO BOUNDARIES!!

SOLIDARITY DOESN'T NEED ANY!!
Against Borders, Prisons, and Repression
On May 21, 2008 24 apartments, houses, and offices were stormed and searched by special forces of the police (WEGA) throughout Austria. Some people were awoken in their beds with weapons drawn on them. The grounds for the house searches is the accusation of formation of a criminal organization according to §278a. Specific allegations have still not been brought against individual persons.
10 activists have been detained for weeks and are still in jail!
We declare our solidarity with the imprisoned and want to show that, no matter how long the detainments and repression last, the support from outside will not end! We will demonstrate to lend a voice to our solidarity with the prisoners and our anger against the state repression apparatus.
We want to make clear that we do not need an occasion like the present one to know that repression is an intrinsic part of the daily praxis of the state of Austria.
The fates of those such as Seibane Wague, Markus Omofuma and many others who lost their lives during operations of the Austrian police must never be forgotten.
What appear to be tragic isolated cases must be understood as the corresponding logic of the Austrian state, which is namely racist, homophobic, sexist or simply against all those who desired or undesired evade state control. Those supposed isolates cases simply represent the pinnacle of a system of repression against “difficult” persons and minorities.
Today we show are solidarity with all those who are confronted with state repression in all its various forms. It does not matter whether we are talking about the politically organized left in France and Germany, which is being criminalized through the use of “terrorism paragraphs,” animal rights activists who are being held in prison in Austria because of their engagement for animal rights, people who have been confronted with surveillance and spying, immigrants and the unemployed, who are harassed by state officials or asylum seekers who are confronted with repression almost everywhere in the world, often in the form of torture, deportation jails and deportation itself. Repression knows no boundaries, solidarity doesn't need any.
Only a few have been directly targeted – but we are all intended targets!
* Abolish all “criminalization paragraphs” like the Austrian §278a and the German §129a/b!
* Immediate closing of all deportation jails!
* Unlimited right to stay for everyone!
* The immediate release of all political prisoners!
* Disbandment of the WEGA!

The activists are still in prison, one of them still in hungerstrike, put with forced feeding by the authorities. The solidarity protests are still going on - lots of protests around the prisons, but also in many other parts in austria and abroad.
On June 21, 2008, one month after the arrest, some 400 people ralleyed in vienna (see call above). This demonstration also went to one of Viennas detention centers for immigrants (a prison, running by the police) and to the investigation prison, where some of the animal right activists are detained. The demonstration ended at the monument for marcus omofuma, who was killed during a forced deporation on May 1, 1999.

A Complete Miscarriage of Justice - OLG Upholds Pre-trial Confinement for Animal Rights Activists!
After the pre-trial confinement was extended for all ten imprisoned animal rights activists in Wiener Neustadt on July 7, 2008, the Oberlandesgericht (OLG, the Appellate Court) upheld the confinement. This means that the imprisoned activists will remain in confinement for another two months until the next evaluation in September.
Monika Nowak, the spokeswoman for the legal support, reacted to the OLG-Decision, "The confirmation of the confinement for the animal rights activists is outrageous! The miscarriage is complete! This opens up the floodgates for the future criminalization of NGOs."
It is scandalous that house searches and arrests of ten animal rights activists were conducted on May 21, 2008 without any specific charges. They could only be surveilled and investigated by drawing on the smokescreen paragraph 278a - Membership in a Criminal Organization.
It is scandalos that the pre-trial confinement was justified with "Danger of Destruction of Evidence" because of e-mail encryption and with "Danger of Committing Crimes" because of the long-time political activism of the prisoners.
It is also scandalous that the prosecution has repeatedly offered to release some of the activists if they disclose the passwords for their computers.
It is likewise scandalous that it is being held against some of the prisoners that they have repeatedly applied their right to remain silent from the police and prosecution and insist that they will only make statements in the course of a fair trial.
All this suggests that the activists are being subjected to a sort of coercive detention to make them incriminate themselves - which is not a legal practice in Austria - because they have not been accused of specific criminal acts and also the disproportionately violent house searches apparently produced none of the hoped for evidence of any kind.
Monika Nowak, spokesperson of the legal support, sums up, "I demand the immediate release of the prisoners and a complete and independent elucidation of the polical motivations of this campaign aimed at criminalization from the police and justice departments."

Chris Released!!!
antirep2008 15.Aug.2008 19:19
On Tuesday, August 13 2008 there were evaluations of the pre-trial detentions of Chris and Martin in Wiener Neustadt. Their attorneys had applied for an immediate release from detention from the presiding judge in the case. Although the pre-trial detention was reaffirmed by the judge for Martin, the judge decided to immediately release Chris. Although the prosecutors have appealed this decision, Chris is currently living in freedom.
