Attempted murder of an antifascist
23 May 2006 00:23 GMTA few days ago, at 6pm on the evening of the 16th of May, at the corner of Tamka and Dobrej streets in Warsaw, an antifascist activist was attacked by two nazis, with clear intentions to kill him. They had been following him, and suddenly, one of them stepped in front on him and sprayed him with pepper gas. Then the other one stabbed him in his back with a 30cm long knife. Maciek fell on the ground and was kicked by the nazis for a while, with them shouting "We'll kill you, you leftist motherfucker!".
Maciek was taken to the hospital and underwent serious life-saving surgery (when he got to the hospital the doctors said that his condition was "critical"), and is now recovering. He still is not 100% recovered, he still has blood in his lungs. He says that he is sure that the attack was due to the recent appearance of his personal data on a nazi site called "redwatch" (www.redwatch.info) which publishes names, addresses, photos and other personal data of human rights activists in order to encourage violent attacks against them. Redwatch is a web-site that has existed for several months now and it promotes the idea of "killing the enemies of the race" and the organization behind this is a very radical neofascist "Blood and Honor". The problem is that Maciek didn't have medical insurance, so that he may be forced to pay up to 20,000 PLN (5000 euros).

I think the idea of violently attacking nazis is perhaps the most misguided idea I've ever heard. What exactly makes you different from them? You both have committed a COWARDLY act of violence in the name of your beliefs. This is exactly what the nazi, a troubled soul who has lost hope in the decency of mankind, hopes for. Your use of a fascist tactic- violence -puts you both in the wrong. Nonviolence is not just another political idea like fascism or socialism. It is indeed the 'law' followed by all other living creatures but humans, and creates the impulse to control others out of fear. Nazis are victims of this fear who have hardened their hearts and embraced evil, choosing to victimize others and enjoy the sense of power. Don't let this be true of you as well.

I once thought peace is good and it is, I once thought things could be solved through resolution. However before then I thought we should just punch the fuckers up who make this world a bad place. Now I realise neither ever work, and nothing does. People are fucked, there is no humanity, no love, but at the same time there is lots of it. I hate this fucking planet.
However, on the side of whats more important I think LIFE is the most important, so I have to agree with peaceful resolution this time around. Just ignore the fucking nazi's and do your own thing, and don't make a big violent fuss about it. Because if you do that you are as bad as them, but if you fear them you let them win.

I do agree that violence has to be last resort. But sometimes you dont have any choice. If you don't do nothing and you mind your own buissness as some suggested, it won't solve anything. Still the hate crimes will occure, still people will be stabbed and kicked, and still nazis will gain their power. That solution of non violence, that peacfull approach as someone comment it, it's more or less the same what was practiced during the Wehimar Republic when nacism just emarged as new ideology. People were reluctant to do anything about it and finally when they realised that is the hour to fight fasiscm it was too late. I've seen that in front of my own eyes in ex-yu teritory where most of "normal" people ignored rise of nationalism and fascistic idelogies hoping that by ignoring it will go away. It didn't, far from it. It just gain power leaving us in conforntatin with an enemy too strong to be conquered. And reprcussions came, so big and so overwhelming that we are still feeling consequences of it.
So yes, we do need to fight fasism, sometimes with violence beacuse when confronted with pure hatered, for ever reason and with every justifacation, you have no choice. Either you will fight or you will perish.
Here in Europe we've seen what can tolerance towards facism do. Do we really have to experinece all that again?

by the Constitution or laws of this state or by the Constitution or

In section (c) it's clear that hate speech is a relevant factor in convicting someone of a hate crime in California, even hate speech alone without an action is a crime - under the very special circumstances defined in that law, such as threatening violence against a specific person, which is clearly the case for the redwatch.info site:
However, no person may be convicted of violating
subdivision (a) based upon speech alone, except upon a showing that
the speech itself threatened violence against a specific person or
group of persons and that the defendant had the apparent ability to
carry out the threat.
So DreamHost's clients (of the redwatch.info site) are committing a crime under Section 422.6 of the Californian Penal Code since they are making "speech which itself threatens violence against specific persons". They risk 12 months prison or a $5000 fine.
DreamHost has a clause about not allowing content which is illegal.
If DreamHost management acts in "good faith" to prevent the continued crime, then they would presumably be able to defend themselves from being convicted as a supporting partner in crime and avoiding having to manage the DreamHost service from inside a prison cell.

Redwatch was recently moved to DreamHost because for many years DreamHost has refused to remove sites opposing Redwatch. Similar tactics as are being suggested here on this forum were used to try to take down the opposing websites. Indymedia, being a source of alternate voices, must be very aware of the full implications of free speech, both good and bad. If you know or beleive that a crime has been committed please contact the proper law enforcment agencies so that the perpetrators can be brought to justice.

Theres also a precedent , made in a case by the Southern Poverty Law Centre (not sure which one, as Im an Aussie, so US laws are not my area), where one of the US Nazi groups, possibly WAR, or WCOTC, or something, was held responsible for the actions of a member who murdered a young American of Colour.
I'd dig it up, and then point out to DreamHost, that already the site has incited an attempted murder, and they should be advised that the victim, or a advocacy organisation on his behalf might be interested in pursuing legal action to obtain compensation.
Its both a real statement, and should remind them that Hate has its consequences, including for its enablers.

I can't go into a lot of detail about any specific case, but as the main person who handles these sorts of issues at DreamHost I thought I should probably say something about our policies.
Regarding our free speech policies:
We do have a very strong free speech policy, and at any given point in time we likely host hundreds of sites that every single employee in our company would find personally abhorrent and offensive. That said, our belief is that freedom of expression should apply equally (if not especially) toward those who have unpopular opinions. Otherwise, there isn't much point in having freedom of speech at all.
So, yes, this means that we host sites promoting racist/fascist ideology (and, for that matter, sites promoting just about every ideology out there - mainstream or otherwise). We recognize that some customers may be uncomfortable with this, but it is a policy that is unlikely to change in the foreseeable future.
However, we also recognize that freedom of speech does not cover everything, and our own policies reflect this. We do not allow for customers to violate US law, for example. This applies not only to things like copyright infringement, but also the hosting of child pornography, death threats, etc.
As such, we have a long and cooperative relationship with law enforcement. Upon receiving complaints regarding the legality of a given site we investigate it internally, calling upon law enforcement in situations where we feel that it is warranted. The nature of such investigations is such that we are often unable to comment on their status or provide details on what is going on behind the scenes.
As for this case in particular, I can only say this: We're aware of the site, and of the concerns and facts surrounding the recent incidents in Poland. If any of you can provide us with additional information that could be of use, please don't hesitate to let us know. Beyond that, though, I'm afraid that we cannot comment on this matter any further.

Should DreamHost choose to disable legal, free-speech-exercising sites
that some people don't agree with, we open the door to having to decide
what other sites to censor as well. We absolutely agree with every
customer's right to free speech and recognize that we're not one to
infringe upon it.

Yeah Jeff, I too recognize that some people may be uncomfortable with a knife stuck in their back as a result of your commitment to free speech.
Free speech is only free when its impact doesn't cause attempted murder upon innocents. After that, it's no longer free speech, and so you're not even able to uphold your open policy in this matter. So either try and use a different argument, or better yet, shut the fuck up.

Redwatch.info is hosted by dreamhost who have been real assholes. I've heard through the grapevine that Dreamhost has sustained DDoS attacks and mailbombings so they can't have much left in them.

Redwatch is an illegal site where I am viewing it (The United States) and where you are located (The United States). It posts personal information of people who share similar political views about communism. The information is posted with the intention of causing physical harm to these individuals. The site owners are well aware of this. In fact, harm has been caused to various individuals including this most recent case where somebody was stabbed due to their information getting posted on redwatch:
Redwatch also posts slanderous information about individuals or groups that have communist beliefs.

As you can see, this provided enough information for these people to be attacked merely because of their political views. In fact people have been attacked and the owners of this website are very aware:

Redwatch is a web-site that has existed for several months now and it promotes the idea of "killing the enemies of the race" and the organization behind this is a very radical neofascist "Blood and Honor". The problem is that Maciek didn't have medical insurance, so that he may be forced to pay up to 20,000 PLN (5000 euros)."

Bugs me that this dwindled into a debate about violence and non-violence. The fact is that if Bush and these Nazis in Poland didn't think the world's good folk were a bunch of fucking sissies not even willing to stand up for their own bodily right to live and breathe (let alone have access to education, jobs, healthcare, et cetera), they wouldn't have pushed it this far. The fact is that we have to stand together, and yeah, at first it's going to involve a lot of fucking fighting among each other. To hell with it. Why not? I'm not scared. I can handle myself.
