Aucune réforme positive de la justice française ou européenne n'a fait suite à l'affaire d'Outreau. En revanche, les mesures aggravant la situation n'ont pas manqué. A présent, Nicolas Sarkozy, François Fillon et Rachida Dati voudraient mettre en cause le principe même de la gratuité de l'aide juridictionnelle pour les justiciables sans ressources. Ce qu'aucun président, gouvernement ni garde des Sceaux n'avait osé dans l'histoire française récente. Une politique radicalement à l'opposé des espoirs que les citoyens avaient pu héberger lors de la diffusion du rapport parlementaire sur l'affaire d'Outreau en 2006.
