Indymedia.us and the EFF successfully fight back against bogus FBI subpoena

Indymedia.us is happy to announce that we've managed, after nearly a year of legal action on our behalf by the Electronic Frontier Foundation, to successfully fight back against a bogus subpoena request issued by the FBI in conjunction with a grand jury investigation. The request demanded we turn over all IP address logs for a day in June of 2008 - not only did Indymedia.us object to this blatantly illegitimate and overly broad request, but, per accepted Indymedia best practices, we do not keep such logs in the first place, in order to maximally ensure the privacy of our site users. Also troubling was the fact that the indymedia.us sysadmin who received the subpoena was also bound by its gag order provision, making her unable to discuss the legal issue with the broader network of collectives cooperating on the indymedia.us site. We're happy that the EFF was ultimately able to get this demand for silence shown to be illegitimate as well --- one can only wonder how many ISPs silently capitulate to similarly broad and unconstitutional requests. Last weekend, I had the pleasure of attending the 10-year Indymedia Anniversary Gathering in Troy, NY.

Ten years ago this month, thousands of peaceful protesters faced down a massive paramilitary force in Seattle—successfully preventing the World Trade Organization from meeting and marking a new era of resistance to corporate globalization.

Their struggle was documented on the ground by a new media activist phenomenon called Indymedia, which has since spread around the world.

David Irving is a notorious pro-Nazi history writer. He has made repeated anti-Semitic, Holocaust Denial and racist statements over the years, including that "no document whatsoever indicating the Holocaust occurred" has been found, and "the holocaust of the Germans of Dresden was real. The holocaust of the Jews in the Auschwitz gas chambers is a fabrication." Although he has retreated from some of these statements, Irving has continued to blame Jews for what the Nazis did to them; he attempts to minimize the scope of the Holocaust; and he publicly praises Adolf Hitler.

From EFF's Secret Files: Anatomy of a Bogus Subpoena

On January 30th, 2009, Kristina Clair of Philadelphia, PA — one of the system administrators of the server that hosts the indymedia.us site — received in the mail a grand jury subpoena from the Southern District of Indiana federal court. The FBI had sent an email to Ms. Clair a couple of weeks earlier asking where a subpoena directed at the indymedia.us site should be sent. So, we at EFF were ready and waiting to evaluate the subpoena as soon as it arrived. Yet even we were surprised at what we saw.

Justice Dept. Asked For Broad Swath of IndyMedia's Visitor Records

In a case that tests whether online and independent journalism has the same protections as mainstream journalism, the Justice Department sent Indymedia a grand jury subpoena. It requires a list of all visitors on a day, and further, a gag order to Indymedia "not to disclose the existence of this request". CBS reports that "Kristina Clair, a 34-year old Linux administrator living in Philadelphia who provides free server space for"Indymedia.us, said she was shocked to receive the Justice Department's subpoena", and that "The subpoena from U.S. Attorney Tim Morrison in Indianapolis demanded "all IP traffic to and from www.indymedia.us" on June 25, 2008. It instructed Clair to "include IP addresses, times, and any other identifying information," including e-mail addresses, physical addresses, registered accounts, and Indymedia readers' Social Security Numbers, bank account numbers, credit card numbers, and so on". From NARAL Pro-Choice America: Nancy Keenan, president of NARAL Pro-Choice America, called House passage of a stunning last-minute anti-choice amendment to health reform an outrageous blow to women's freedom and privacy — and she vowed to fight to remove this provision as the process goes to the Senate. The amendment, offered by anti-choice Reps. Bart Stupak (D-Mich.) and Joe Pitts (R-Penn.), was adopted by a margin of 240-194. The Stupak-Pitts amendment makes it virtually impossible for private insurance companies to offer abortion coverage to women, denying women the right to use their own personal private funds to purchase an insurance plan with abortion coverage in the new health system. Presently, more than 85 percent of private-insurance plans cover abortion services.

One of the disadvantages of current representative democracies is the discrepancy between the agenda of the regular citizen and the agenda of leaders and political elites. As the practices of direct democracy lose ground to the dominant-elitist decision making system, people's interest in the fairness of state policies decreases, and criticisms of governing actions are usually isolated and more symbolic than mobilizing.
